1) General conditions

The company Roto dinamic d.o.o., Oreškovićeva ulica 6H/1, 10010 Zagreb, PIN: 24723122482 (hereinafter referred to as "Roto dinamic" or "Seller") provides interested parties with the opportunity to purchase products from its assortment using the online e-commerce service, which can be accessed via the website webshop.rotodinamic.hr (hereinafter referred to as the "Website", and the online e-commerce service as the "Webshop"). This service implies an always up-to-date offer of items selected by the Seller, the possibility of electronic payment for the selected products, and the organization of delivery of the purchased items to the person who placed the order or purchase order to the Seller via the Webshop (hereinafter referred to as the "User" or "Buyer").

These General Terms and Conditions govern the entire procedure of selling products to the User by the Seller. By placing an order with the Seller or confirming an order, the User/Buyer confirms that they are fully aware of and agree to these General Terms and Conditions, as well as the terms of purchase for the specific product.

The General Terms and Conditions applicable to a specific transaction between the Seller and the User are those publicly published on the Website through which the transaction is conducted at the time of transaction confirmation. Users are advised to check the valid General Terms and Conditions before each purchase.

The right to use the Webshop is a personal right of the User and cannot be transferred in any way to other natural or legal persons, nor is any user authorized to register other natural or legal persons.

The Product Purchase Agreement between the Buyer and the Seller is considered concluded at the moment of product order confirmation, for which the Seller issues a confirmation to the User electronically. In the event that the User wishes to cancel the order, they may do so no later than one hour from the receipt of the Seller's confirmation by sending a request to the e-mail address narudzbe@rotodinamic.hr or by calling (01) 3903 440.

The User or Buyer can only be an adult (of legal age) natural person with full legal capacity or a legal entity. The Seller bears no responsibility for actions contrary to this provision.

The User or Buyer is personally responsible for protecting the confidentiality of passwords where they exist as such. The User is obliged to provide accurate, complete, and valid personal data when filling out the registration form. Acting contrary to this authorizes the Seller to deny such user access to or the realization of all or part of the provided services.

In the event of occasional interruptions to the Seller's services, which may be caused by technical reasons or during the transmission of information on the Internet, the User shall not hold the Seller responsible for any loss of data.

The Seller reserves the right, at any time and without prior notice if deemed necessary, to cancel or amend the content of the General Terms and Conditions, product assortment, product prices, or the content of the Website.

The Webshop is used exclusively at the User's own risk. The Seller is released from any liability for damage that may have occurred during the visit to the Website due to unlawful actions of third parties, computer viruses, communication line interruptions, unauthorized access, inappropriate behavior, negligence, and similar cases for which the Seller is not responsible. The Seller is released from all liability in the event of circumstances that prevent the use of the Webshop. The terms of this chapter apply to the entire content of the Website.

All content posted on the Website is intended to facilitate the buyer's choice when shopping. The Seller reserves the right to errors in product descriptions and photographs, which are of an informative nature and provided based on the manufacturer's information. We are not liable for unintentional errors. Vintage Availability: The vintage year of the wine offered for sale by the Seller is not necessarily the vintage year visible in the product photograph. If the Buyer requires a specific vintage year of the selected product, it is necessary to state the desired vintage year in the message to the seller when submitting the order, so it can be prepared for delivery if it is still available. For every inquiry sent regarding vintage availability, the Buyer will receive an answer before delivery.

The Consumer Protection Act (Official Gazette No. 41/14, 110/15) applies to these business terms.

2) Types and methods of payment

Prices are retail prices, including the applicable VAT, in the official currency of the Republic of Croatia.

The stated prices are valid for purchases in the Webshop, independently of any eventual price for the same product in other Roto dinamic brick-and-mortar stores. The Seller is authorized to change prices without prior notice, just as it is authorized to change prices exclusively for the Webshop without prior notice.

Promotional Sales, Clearance Sales, and Other Special Forms of Sale: The Seller will periodically, at its own discretion, place certain products on promotional sale. Products on promotional sale are visibly marked with the word "Akcija" (Promotion/Sale), have a clearly displayed promotional price, the lowest price in the last 30 days, and the duration of the promotional sale.

From time to time, the Seller will organize clearance sales of certain products under the names "Žuti popusti" (Yellow Discounts) or "Black Friday". The reason for these clearance sales is the discontinuation of certain products from the Seller's assortment. In these clearance sales, product quantities are limited, the sale lasts until stocks run out, and the clearance price and the lowest price in the last 30 days are clearly highlighted.

Additionally, the Seller will occasionally organize other special forms of sale under different names.
The conditions of these special forms of sale will be described in detail.

Conditions for Using Discounts:

  1. Percentage discount on the entire invoice by entering a coupon code: A percentage discount on the total shopping cart amount can be used once by entering a valid coupon code during the order process. The validity period of the coupon code is stated in the message accompanying the received coupon, and it may be in the form of an expiration date or a specific number of days from the receipt of the coupon code. This discount does not apply to products included in special forms of sale (promotions, clearance sales, and discounts due to expiration dates) or products from the "Coffee Beans" (Kava u zrnu) category.
  2. Absolute discount on the entire invoice by entering a coupon code: An absolute discount on the total shopping cart amount can be used once by entering a valid coupon code during the order process. The validity period of the coupon code is stated in the message accompanying the received coupon, and it may be in the form of an expiration date, a date range, or a specific number of days from the receipt of the coupon code. Unless otherwise stated, this discount is redeemable subject to the minimum shopping cart value limitations specified in the message accompanying the coupon. The absolute coupon amount cannot be used on products included in special forms of sale (promotions, clearance sales, and discounts due to expiration dates) or products from the "Coffee Beans" category.
  3. Percentage discounts on a specific product or group of products during promotions by entering a coupon code: A coupon code providing a percentage discount on marked products or a group of products can be used multiple times on multiple products highlighted in the promotion during the promotional period.
  4. Other conditions for redeeming coupon codes: To redeem certain coupon codes, the user must be registered and logged in during the order process, as specified in the message accompanying the received coupon. Only one discount coupon code can be used for each individual order. It is not possible to combine multiple discount coupon codes in a single order.

Ordered products can be paid for in full using the following methods:

  • Maestro, MasterCard, Visa, Visa Premium, Visa Inspire, Diners, and Discover cards
  • Cash on delivery (COD) in cash to the courier upon picking up the products
  • Via the KEKS Pay application
  • By bank transfer based on a pro-forma invoice (Quotation) to the transaction account

Payment by Debit and Credit Cards: If you have chosen to pay by card, you select the type of card you are paying with on the secure mStart iCheckout page and enter the cardholder information along with other required data.

Cash on Delivery (COD): Cash on delivery allows you to settle your orders at the time of delivery to the specified address, i.e., only when you see the product in front of you. COD payments are made exclusively in cash to the courier upon delivery to the indicated address. The service fee for cash on delivery is charged in the amount of EUR 0.66.

Payment via the KEKS Pay Application: To use this service, it is necessary to install the free KEKS Pay application on your smartphone. Customers can pay the invoice very easily by scanning the QR code. The fastest way and with no fees via the KEKS Pay app!

Payment by Bank Transfer (Pro-forma Invoice) to the Transaction Account: In the case of payment by bank transfer, the processing of the order and the organization of delivery will be initiated after the payment is received on the transaction account specified in the pro-forma invoice. Quotations are generated automatically and are valid for 4 days. In the case of unavailable items, a refund for those items will be issued to the Buyer's transaction account in accordance with the terms stated in the quotation.

3) Delivery and collection of goods

The Seller delivers ordered products independently through its own delivery service or uses the services of the carrier DPD Croatia d.o.o. (https://www.dpd.com/hr/hr/).

For orders placed on business days (Monday to Friday), the Seller will process the order and place it into the delivery procedure on the same or the following day. For orders placed on weekends, public holidays, and non-working days, order processing will be carried out on the first following business day.

Upon the Seller assigning the delivery order to the carrier DPD Croatia d.o.o., mainland deliveries will be executed according to the carrier's general terms within a period of 5-7 business days from the receipt of the assignment. Exceptions apply to deliveries to island locations and smaller towns where delivery times may be longer, given that daily delivery is not performed and is executed according to the carrier's general terms and delivery schedule. For deliveries carried out independently by the Seller via its own delivery service, the delivery period cannot be longer than the delivery period when using DPD Croatia d.o.o. The Seller is not responsible for any delays in package delivery caused by the delivery service and unfortunately cannot influence the exact time of delivery.

Delivery is made to the entrance of the residential unit (apartment, house, business premises, etc.) at the address indicated by the User, and can be organized exclusively within the territory of the Republic of Croatia.

Delivery Costs within Croatia (Except for Islands Not Connected by a Bridge): The Seller provides free delivery (without charging delivery costs) for individual product orders equal to or greater than EUR 60.00, except for islands that are not connected to the mainland by a bridge. Delivery for individual orders whose total amount is equal to or less than EUR 59.99 is charged at a price of EUR 5.99. In this case, the delivery cost item forms an integral part of the total offer to the customer.

Delivery Costs to Croatian Islands Not Connected by a Bridge
: For product deliveries to Croatian islands that are not connected to the mainland by a bridge, regardless of the total order amount, the Seller charges an island delivery surcharge of EUR 7.50 per order. The island delivery surcharge item forms an integral part of the total offer to the customer. Additionally, if the amount of such an individual order is equal to or less than EUR 59.99, a standard delivery fee of EUR 5.99 will also be charged. In that case, both the delivery cost and the surcharge items form an integral part of the total offer to the customer.

Ordered products will be packaged in such a way that they cannot be damaged during standard transport handling. The Buyer is advised to inspect the shipment before collection, report any visible damage immediately, and refuse to accept a damaged shipment.

Upon taking over the goods, the Buyer is obliged to sign the delivery note or waybill, which the courier takes as proof of collection. The receipt of goods must be signed by the person indicated as the User during ordering. If any other person takes over the goods at the location, the delivery will be considered properly executed.

In the event that the Buyer does not receive the goods within the agreed period, they are requested to notify the Seller as soon as possible via e-mail or telephone.

4) Claims, Returns, and Complaints

We invite Buyers who are dissatisfied with our service or the delivered product to contact us with confidence so that we can consider the complaint, resolve the claim as quickly as possible, and try to improve our service to the satisfaction of all Customers.

The Buyer may submit a written complaint by sending an e-mail to prigovori@rotodinamic.hr or by mail to the address Roto dinamic d.o.o., Kovinska 1, 10000 Zagreb, marked "ZA WEBSHOP – PRIGOVOR" (FOR WEBSHOP – COMPLAINT).

In order to check the order you are complaining about as quickly as possible, please provide the order number, basic Buyer information (first and last name, e-mail address, and contact phone number), a detailed description of the claim, and, if necessary, photographs of the claimed product. 

After receiving the complaint, we will send you an acknowledgment of receipt. We will respond to your complaint no later than 15 days from its receipt, in accordance with the provisions of the Consumer Protection Act.

We will accept the Buyer's claim in the case of delivery of damaged, defective, or incorrectly delivered products (incorrectly delivered regarding the type and quantity of products compared to the order), products that have expired, or products that have a defect or damage that did not occur during transport. We will execute a return or replacement of such products at our own expense if we determine that the claim is justified and that the Buyer did not affect the correctness, damage, or any other defect of the delivered products. In the case of a justified claim, the cost of replacing the product with a new product or products is fully borne by the Seller.

Material Defects
: In the case of goods with a material defect, the Seller shall, in accordance with the provisions of the Civil Obligations Act and at the choice of the Buyer: remove the defect from the goods, deliver another product without defects, or lower the price. If a subsequent reasonable period for fulfillment expires, or even without leaving a subsequent period if the Seller has declared after notification of defects that it will not fulfill the contract, or if it clearly follows from the circumstances of the specific case that it will not be able to fulfill the contract even within a subsequent period, the Seller shall, at the request of the Buyer, refund the amount paid for those products or fulfill any other obligation required under the provisions of the Civil Obligations Act regarding liability for material defects.

In the event of a material defect in a product, the provisions of the Civil Obligations Act regarding liability for material defects of items apply to the relationship between the Buyer and the Seller. The Seller informs the Buyer that the governing provisions regarding rights and obligations concerning material defects are prescribed by the relevant articles from Art. 400 to Art. 422 of the Civil Obligations Act.

The Buyer can submit a complaint regarding a material defect in the manner specified under Complaints, returns and objections.

The Buyer's Right to Unilateral Termination of the Contract: The contract concluded between the Buyer and the Seller for the purchase and sale of products and services is a one-time contract that is consummated upon the delivery of the products by the Seller and the execution of payment by the Buyer, provided it has not been terminated beforehand. These General Terms and Conditions form an integral part of the Purchase Agreement between the Seller and the Buyer. In accordance with the provisions of the Consumer Protection Act, any Contract concluded via remote communication (online store) may be unilaterally terminated by the Buyer without stating reasons within 14 days from the date of delivery of the products from the order. The 14-day period begins from the day the Buyer, or a third party designated by the Buyer who is not the carrier/courier, takes physical possession of the product that is the subject of the contract. In the event that the Buyer exercises their right to unilateral termination of the contract, the direct costs of the return are fully borne by the Buyer.

Within the 14-day period, the Buyer is obliged to notify the Seller of the unilateral termination of the Contract:

  • By sending a completed form for unilateral termination of the contract by mail to the address Roto dinamic d.o.o., Kovinska 1, 10000 Zagreb, marked "ZA WEBSHOP – JEDNOSTRANI RASKID UGOVORA", or by e-mail to prigovori@rotodinamic.hr.   • By sending any other unambiguous statement in which the Buyer expresses their will to unilaterally terminate the contract, specifying the order number and basic Buyer information (first and last name, address, phone number, and e-mail address) by mail to the address Roto dinamic d.o.o., Kovinska 1, 10000 Zagreb, marked "ZA WEBSHOP – JEDNOSTRANI RASKID UGOVORA", or by e-mail to web.roto@rotodinamic.hr.

Once the Seller receives the Buyer's statement or form for unilateral termination of the Contract, it will notify the Buyer of its receipt without delay.

In the event of unilateral termination of the Contract, each party is obliged to return to the other what it received under the Contract, in accordance with the provisions of the Consumer Protection Act.

Within 14 days from when the Seller is notified of the Buyer's decision to unilaterally terminate the Contract, the Buyer is obliged to return the goods to the Seller. The Buyer exercising the right to unilateral termination independently bears the direct costs of returning the goods. The goods must be returned to the address Roto dinamic d.o.o., Kovinska 1, 10000 Zagreb, marked “POVRAT WEBSHOP – JEDNOSTRANI RASKID UGOVORA”. The Seller is not responsible for any issues with the delivery service used by the Buyer for the return; therefore, the Seller advises the Buyer to request a shipment tracking number. This ensures the Buyer knows the product has been delivered to the Seller. Furthermore, the Seller is not responsible if the Buyer returns the product to the wrong address.

In accordance with the Consumer Protection Act, the Buyer is responsible for any reduction in the value of the goods resulting from handling the goods, other than that which was necessary to determine the nature, characteristics, and functionality of the goods. The Buyer is obliged to return the goods in their original and undamaged packaging, with all associated parts and documentation. The Seller will determine any reduction in the value of the purchased goods caused by damage/loss of packaging or damage to the goods not caused by functionality checks individually for each returned item and notify the Buyer upon receipt of the returned product.

The Seller will execute the refund of the amount paid only after the product is returned to it, or after the Buyer provides proof that they have sent the product back to the Seller, provided the Seller was notified of this before receiving the goods. Once the Seller establishes that the returned product meets all return conditions, the refund of the paid funds will be executed using the same means of payment used by the Buyer during the initial transaction, unless the Buyer expressly agrees to another means of payment, and provided that the Buyer does not incur any fees as a result of such refund.

The Buyer does not have the right to unilateral termination of the Contract in cases prescribed by the Consumer Protection Act (goods made to the buyer's specifications, clearly personalized goods, perishable goods or goods that expire rapidly, sealed goods which are not suitable for return due to health protection or hygiene reasons if they were unsealed after delivery, goods which are, after delivery, according to their nature, inseparably mixed with other items, etc.). Complete information regarding the buyer's right to unilateral contract termination can be found in the Consumer Protection Act.

5) Privacy and security

Protection of personal data

  • The Seller collects the Buyer's personal data only with their prior consent and to the extent necessary to fulfill its obligations. It may use this data to inform the Buyer about new and promotional products, deliver promotional materials and newsletters, improve customer relationships, and verify other data essential for online shopping.
  • In addition to the Seller, a specialized webshop development company has access to the newsletter database and the customer database containing Buyers' personal data.
  • The Seller undertakes to protect the personal data of Buyers in accordance with the Personal Data Protection Act and undertakes not to disclose personal data to third parties in any way without the Buyer's consent (except for data necessary for business partners to execute the delivery of the purchased product). This excludes cases in which the Seller is obliged by law, under a valid order from authorized state authorities, to provide or allow access to the personal data of Buyers./li>
  • The Seller does not record your credit card number or store transaction data; instead, it uses the services of an authorized third-party bank for credit card billing, which protects your data using encryption.
  • The Buyer has the right to request the completion, correction, or modification of inaccurate personal data.

Privacy and Confidentiality Statement for Personal Data: ROTO DINAMIC d.o.o. is responsible for all websites it owns and all contained data, and is compliant with the General Data Protection Regulation (GDPR).

During User registration for the use of the Webshop, the Seller collects and processes User data based on their consent for the purposes explicitly stated in the consent itself, in accordance with Article 7 of the Personal Data Protection Act. In the event that the User wishes to revoke the granted consent, they can do so by clicking "unsubscribe" or by sending an e-mail to dpo@rotodinamic.hr. Upon receiving the request to revoke consent, the Seller will permanently destroy all data about the User, except for data it is obliged to retain to fulfill its assumed obligations toward the user or due to obligations prescribed by the positive regulations of the Republic of Croatia. If the User does not withdraw the granted consent earlier, the Seller stores and processes personal data only as long as necessary to fulfill a specific legitimate purpose, unless a longer retention period is provided for a specific purpose by applicable regulations. In the case of granting consent for marketing, we retain the data until the consent is withdrawn.

In making efforts to maintain the website according to our users' needs with the required information, we use technology that collects, processes, and selects data on how our website is used. We collect this information using "cookies".

Purpose of Data Collection:

  • Product Sales – to process your sale transaction
  • Customer Support and Marketing – to respond to inquiries and provide news and offers

Personal data may be transferred to third parties, provided there is a legal basis for the transfer:

  • For the execution of the goods delivery contract, we will share data with the distribution service providers with whom we cooperate and have concluded contracts. The distribution service provider, according to its business terms, may ask the user for an identity document for inspection upon delivery of goods or services and/or record certain data from the document. If the user is unwilling to provide such data necessary for package delivery (i.e., proof of the purchaser), the service or goods cannot be executed or delivered.
  • State institutions that request access to data for third-party processing purposes.
  • Companies professionally engaged in the automated sending of advertising messages.
  • Companies used by the Seller for the development and realization of online services.

Webshop: Access to the webshop is possible with or without registration. During registration, the Buyer may be asked for certain personal data such as first and last name, e-mail address, residential address, and telephone number. Upon registration, the Buyer accesses their database within the Webshop. When purchasing without registration, only data necessary for the delivery of the purchased goods is collected, and this data is stored for the purpose of contract fulfillment.

The Website user can choose whether or not they wish to receive promotional messages, regardless of whether they registered through the Website or not. Data provided by the user upon registration is stored on the Webshop server and in the business software, which is accessed by employees of the competent department using access passwords. The Buyer can deactivate their registration at any time.

Personal Data Storage Locations: All data is stored on several media:

  • User data as a buyer: on the webshop pages located on the leased server space of the web hosting company named Fastcomet Inc.
  • In the Point P2000 business software for delivery purposes.

A registered user has the ability to access their data stored on the website at any time, where they can review, change, and delete it. All updates made on the website will also be recorded within the business software after a short delay.

6) Written Consumer Complaint

In the event of the User's dissatisfaction with the Seller's services, a written complaint can be sent via registered mail to the address Roto dinamic d.o.o., Oreškovićeva ulica 6H/1, 10010 Zagreb, or via e-mail to prigovori@rotodinamic.hr. If the User wishes to lodge a complaint in the field of personal data protection, they may do so via the e-mail address dpo@rotodinamic.hr.
