1) General conditions

Company Roto dinamic d.o.o. Ulica grada Wirgesa 14, 10 430 Samobor, OIB: 24723122482 (further in the text Roto dinamic or a vendor) offers to the interested parties the option of buying products from their assortment by using web shop’s online service that can be made through a web page webshop.rotodinamic.hr (further in the text ”Web site, and online web shop service “Web shop”). Subject service implies up to date offers from sellers of selected items, electronic buying option of selected items and delivery arrangement of purchased items to a customer who issued a warrant or a purchase order to a seller (further in the text “user” or a “customer”)

These general conditions regulate the overall procedure of product sales from the seller to the customer by placing an order with the Seller, that is, by order confirmation. User/customer confirms that he is fully acquainted with and agrees to these General Terms and Conditions as well as with the terms of purchase of a specific product.

The General Terms and Conditions that apply to a specific transaction between the Seller and the User are those that are publicly published on the website through which the transaction is performed at the time of confirmation of the transaction. Users are instructed to check the applicable General Terms and Conditions before each purchase.

The right to use the Web Store is a personal right of the User and may not be transferred in any way to other natural or legal persons, nor is any user authorized to register other natural or legal persons.

It is considered that the Agreement on the sale of products between the Buyer and the Seller is concluded at the time of confirmation of the order of the product, of which the Seller issues a confirmation to the User electronically. In case the User wants to cancel the order, he can do the same no later than one hour after receiving the Seller's confirmation by sending a request via e-mail address narudzbe@rotodinamic.hr or by phone at (01) 3903 440.


The User or the Buyer can only be an adult and able-bodied natural and legal person. The Seller shall not be liable for any act contrary to this provision.

The User or the Buyer is personally responsible for protecting the confidentiality of passwords, in places where they exist as such. The user is obliged to provide accurate, complete and valid personal data when filling out the registration form. Acting to the contrary, authorizes the Seller to deny such user access or realization of all or part of the offered services.
In the event of occasional interruption of the Seller's services, which may be caused by technical reasons, and possibly during the transmission of information on the Internet, the User will not be liable to the Seller for any loss of data.

The Seller reserves the right at any time and without prior notice if deemed necessary, to cancel or change the content of the General Terms and Conditions, product range, product price or content of the Website.

The Web Store is used solely at the responsibility of the User. The Seller is released from any liability for damage that may have occurred during the visit to the Website due to illegal actions of third parties, computer viruses, interruption in the communication line, unauthorized access, inappropriate behavior, negligence and the like and other cases for which the Seller is not responsible. The seller is released from any liability in the event of circumstances that prevent the use of the Web store. The terms of this chapter apply to the entire content of the Website.

All content posted on the Website is set up to make it easier for the customer to make a choice when making a purchase. The seller reserves the right to make errors in the descriptions and photographs of products that are informative and posted according to the information of the manufacturer. We are not responsible for unintentional errors. Harvest availability: The year of harvest of the wine that the Seller has on sale is not necessary and the year that is visible in the photo of the wine. If the Buyer wants a certain year of harvest of the selected product, it is necessary when sending the order in the message to the seller to enter the desired year of harvest to prepare it for delivery if it is still available. Every inquiry sent regarding the availability of the harvest will be answered to the Buyer before delivery.

The Consumer Protection Act (N.N.41 / 14, 110/15) applies to business conditions.

2) Types and methods of payment

Prices are retail, including VAT, in official currency used in the Republic of Croatia.

The listed prices are valid on the Web store, regardless of the possible price for the same product in other Roto dinamic stores. The Seller is authorized to change prices without prior notice as it is authorized to change prices without prior notice exclusively for the Web Store.

Promotional sales, sales and other special forms of sales:
The seller will periodically, at his discretion, put certain products up for sale. Products on sale are visibly marked with the word "Action", have a clearly stated special price and lowest price in the latest 30 days and the duration of the special sale.

The seller will periodically organize sales of certain products called "Yellow Discounts" or "Black Friday". The reason for these sales is the cessation of sales of certain products from the seller's range. In these sales, the quantities of products on sale are limited, the sale lasts until the expiration of the stock of an individual product, and special price and lowest price in the latest 30 days are clearly stated.

Also, the seller will occasionally organize special forms of selling named otherwise. The terms of these special forms of sale will be described in detail.

Conditions for using discounts:
1. Percentage discount on the entire bill by entering the coupon code
The percentage discount on the total amount of the basket can be used once, by entering a valid coupon code during the order process. The validity period of the coupon code is specified in the message with the received coupon, and it can be in the form of the end date of the coupon code's validity or in the form of the number of days from receipt of the coupon code. This discount is not calculated on products that are included in special forms of sale (promotion, sale and discount due to expiry of deadlines) and on products from the category Coffee beans.
2. Absolute discount on the entire bill by entering the coupon code
The absolute discount on the total amount of the basket can be used once, by entering a valid coupon code during the order process. The expiration date of the coupon code is specified in the message with the received coupon, and it can be in the form of the coupon code's expiration date, the coupon code's duration, or the number of days since the receipt of the coupon code. This discount can be used, unless otherwise stated, subject to the limit of the minimum basket value specified in the message with the receipt of the coupon code. It is not possible to use the absolute amount of the coupon on products that are included in special forms of sales (promotions, sales and reductions due to expiration dates) and on products from the Coffee Beans category.
3. Percentage discounts on a product or a group of products during the duration of promotions by entering a coupon code
A coupon code with a percentage discount on marked products or a group of products can be used multiple times on several products marked in the promotion and during the duration of the promotion.
4. Other conditions for using coupon codes:
In order to use individual coupon codes, it is necessary to be a registered and logged-in user during the order process, and the same is stated on the message with the received coupon. Only one discount coupon code can be used for each individual order. It is not possible to combine multiple discount coupon codes in one order.

You can pay for the ordered products in a one-time payment in the following ways:
• Credit/Debit cards Maestro, MasterCard, Visa, Visa Premium, Visa Inspire, Diners i Discover
• Using PayPal service
• Cash in on delivery to the delivery person when picking up the product
• KEKS Pay App
• Payment according to the offer to the transaction account

Payment by card
If you have chosen to pay by card, on the secure mStart iCheckout page, select the type of card you are paying with and enter the cardholder's information and other necessary information.

COD
Cash on delivery allows you to settle orders during delivery to the specified address, or only when you see the product in front of you. Payment by cash on delivery is made exclusively in cash, to the deliverer upon delivery to the specified address. The cost of COD is charged in the amount of EUR 0.66.

Payment with the KEKS Pay application
To use this service, you need to install the free KEKS Pay application on your smartphone. Customers can pay the bill in a very simple way, i.e. by scanning the QR code. The fastest way and without fees via the KEKS Pay application!

Payment according to the offer to the transaction account
In the case of payment by offer, the start of order processing and organisation of delivery will be initiated after receipt of payment to the transaction account specified in the offer. Offers are generated automatically and are valid for 4 days. In case that some items are undeliverable, the funds for the same will be refunded to the customer's transaction account, according to the conditions of the offer.

3) Delivery and collection of goods


The seller delivers the ordered products independently through his delivery service or uses the services of the carrier DPD Croatia d.o.o. (https://www.dpd.com/hr/hr/).

For orders placed on working days (from Monday to Friday), the Seller will process the order on the same or the next day and place it in the delivery procedure. For orders placed on weekends, holidays and non-working days, the order will be processed on the first following working day.
 
Upon placing an order for delivery to the carrier DPD Croatia d.o.o. by the Seller, deliveries will be made according to the carrier's general terms and conditions within 5-7 working days from the receipt of the order, in the case of land deliveries. The exception is deliveries to island locations and smaller places, where delivery times may be longer, considering that daily deliveries are not made and are carried out according to the general terms and conditions of the carrier and their delivery schedule. In the case of deliveries made by the Seller independently through its own delivery service, the delivery period cannot be longer than the delivery period for which the services of the carrier DPD Croatia d.o.o. are used. The seller is not responsible for any delay in the delivery of the package through the delivery service and unfortunately cannot influence the exact delivery date.

Delivery is made to the entrance to the residential unit (apartment, house, office space, etc.) at the address specified by the User, and it can be organized only in the Republic of Croatia.


Cost of delivery within Croatia (except islands not connected by a bridge):
The seller of delivery of products ordered in the amount equal to or greater than 39.82 EUR per individual order, except for islands that are not connected to the mainland by a bridge, delivers free of charge or without calculating the cost of delivery.

Delivery of individual orders whose amount is equal to or less than HRK 299.99 / 39.81 EUR is charged at a price of HRK 40 / 5.30 EUR. In this case, the delivery cost item is an integral part of the total offer to the customer.

Cost of delivery to Croatian islands that are not connected to the mainland by a bridge:
The seller for the delivery of products to Croatian islands that are not connected to the mainland by a bridge, regardless of the total amount of the order, calculates the cost of surcharge for deliveries to the islands of 6.64 EUR per order. The item of the surcharge cost for deliveries to the islands is an integral part of the total offer to the buyer.

Additionally, if the amount of such an individual order is equal to or less than HRK 299.99 / 39.81 EUR, the delivery cost of HRK 40 / 5.30 EUR will be charged. In this case, the item of delivery cost is an integral part of the total offer to the buyer.

Check the delivery schedule to the islands and places we do not deliver every day here.

The ordered products will be packed in such a way that they cannot be damaged by the usual handling in transport. The buyer is advised to inspect the shipment before collection, and immediately report any visible damage and refuse to accept the damaged shipment.

When taking over the goods, the buyer is obliged to sign a delivery note, which the delivery person takes as a confirmation of collection. Acceptance of the goods is signed by the person indicated as the User when ordering. If any other person picks up the goods at the location, the delivery will be deemed to have been duly made.

In the event that the Buyer does not receive the goods within the agreed time, he is asked to inform the Seller as soon as possible by e-mail or telephone.

4) Complaints and Refunds


We invite customers who are dissatisfied with our service or the delivered product to contact us with confidence to consider the complaint and resolve the complaint as soon as possible, and try to improve the service to the satisfaction of all customers.

The Buyer may submit a written complaint by sending an e-mail to prigovori@rotodinamic.hr or by mail to the address Roto dinamic d.o.o., Jozsefa Antalla bb, 10 020 Zagreb, with the indication FOR WEBSHOP - COMPLAINT.

In order to check the order you object to as soon as possible, please provide the order number, basic information of the Customer (name and surname, e-mail address and contact phone number) and a detailed description of the complaint and, if necessary, photos of the complained product.


Upon receipt of the complaint, we will send you a confirmation that we have received it. We will respond to your complaint no later than 15 days from its receipt, in accordance with the provisions of the Consumer Protection Act.

We will accept the Customer's complaint in case of delivery of damaged, defective or incorrectly delivered products (incorrectly delivered in terms of type and quantity of products in relation to the order), expired products and products that have a defect or damage not caused in transport and return or replacement of such products at its own expense if we determine that the complaint is justified and that the Buyer has not affected the correctness, damage or any other defect of the delivered products. In the event of a justified complaint, the cost of replacing the product with a new product or products is Seller’s obligation.

Material defects

In the case of goods with a material defect, the Seller will, in accordance with the provisions of the Civil Obligations Act, at the option of the Buyer, eliminate the defect in the goods, hand over another product without defects, reduce the price and after notification of defects stated that he will not fulfill the contract or if the circumstances of the case clearly indicate that he will not be able to fulfill the contract in the future, at the request of the Buyer return the amount paid for these products or fulfill another obligation on liability for material defects.

In case of material defect on the product, the provisions of the Law on Obligations on Liability for Material Defects shall apply to the relations between the Buyer and the Seller, and the Seller instructs the Buyer that the relevant provisions regarding rights and obligations regarding material defects are prescribed by relevant articles of Art. 400 to Art. 422 of the Civil Obligations Act.

The Buyer may file a complaint of material defect in the manner specified under "Complaints and Refunds”

The buyer's right to unilateral termination of the contract


The contract concluded by the Buyer with the Seller for the sale of products and services is a one-time contract for the sale of products or services consumed by the delivery of products by the Seller and payment by the Buyer, in case it is not terminated. These General Terms and Conditions are an integral part of the Purchase Agreement between the Seller and the Buyer. Pursuant to the provisions of the Consumer Protection Act, any Agreement concluded via remote communication (online store) may be unilaterally terminated by the Buyer without giving reasons, within 14 days from the date of delivery of the product from the order. The period of 14 days starts from the day when the Buyer, or a third party designated by the Buyer, who is not a carrier / supplier, received the product which is the subject of the contract. In the event that the Buyer exercises his right to unilateral termination of the contract, the direct costs of return are entirely Buyer’s obligations.

Within 14 days, the Buyer is obliged to notify the Seller of the unilateral termination of the Agreement:

• by sending the completed form for unilateral termination of the contract by mail to the address Roto dinamic d.o.o., Jozsefa Antalla bb, 10 020 Zagreb, with the indication FOR WEBSHOP - UNILATERAL TERMINATION OF THE CONTRACT or by e-mail at prigovori@rotodinamic.hr. • by sending any other unambiguous statement in which the Buyer expresses his will to terminate the contract unilaterally and in which it is necessary to state the order number and basic information of the Buyer (name, address, telephone number and e-mail address) by mail to Roto dinamic doo, Jozsef Antall bb, 10 020 Zagreb, with the note FOR WEBSHOP - UNILATERAL TERMINATION OF THE CONTRACT or by e-mail at webshop@rotodinamic.hr.

After the Seller receives the Buyer's statement or the form for unilateral termination of the Agreement, it will notify the Buyer of its receipt without delay.


In the event of unilateral termination of the Agreement, each party is obliged to return to the other what it received under the Agreement, in accordance with the provisions of the Consumer Protection Act.

Within 14 days from the Seller being notified of the Buyer's decision to unilaterally terminate the Contract, the Buyer is obliged to return the goods to the Seller, whereby the Buyer who exercises the right to unilateral termination of the Contract bears the direct costs of returning the goods. The goods must be returned to the address Roto dinamic d.o.o., Jozsefa Antalla bb, 10 020 Zagreb, with the indication "RETURN WEBSHOP - UNILATERAL TERMINATION OF THE CONTRACT". The Seller is not responsible for any problems with the delivery service used by the Buyer during the return, so the Seller advises the Buyer to request a tracking number. In this way, the Buyer is sure that the product has been delivered to the Seller. Also, the Seller is not responsible if the Buyer returns the product to the wrong address.


Pursuant to the Consumer Protection Act, the buyer is responsible for any impairment of the goods resulting from the handling of the goods, other than that which was necessary to determine the nature, characteristics and functionality of the goods. The buyer is obliged to return the goods in the original and undamaged packaging, with all associated parts and documentation. The Seller will determine the impairment of purchased goods caused by damage / loss of packaging or damage to goods that is not caused by checking the functionality of the goods for each returned goods individually and notify the Buyer upon receipt of the returned product.

The Seller will refund the payment only after the product is returned to him, ie, after the Buyer submits proof that the product was sent back to the Seller if the Seller is notified before receiving the goods. After the Seller determines that the returned product meets all the conditions of return, the refund will be made by the same means used by the Buyer when paying unless the Buyer expressly agrees to another means of payment, and assuming that the Buyer is not obliged to pay any additional the cost of such a refund.

The Buyer is not entitled to unilaterally terminate the Contract in cases prescribed by the Consumer Protection Act (goods made to the customer's specification, perishable goods or goods that expire quickly, sealed goods that are not suitable for return due to health or hygiene reasons, if was unsealed after delivery, the subject of a contract for goods which, due to their nature, are inseparably mixed with other items after delivery, etc.). Complete information regarding the buyer's right to unilateral termination of the contract can be found in the Consumer Protection Act.

5) Privacy and security


Protection of personal data

Seller collects Customer's personal information only with his prior consent and to the extent necessary to meet its obligations and may use it to inform about new and promotional products and deliver promotional materials, newsletters, improve customer relations and to verify other information necessary for online shopping.

A specialized company for creating web stores has access to the newsletter database and the Customer database with the personal data of the Customer in addition to the Seller.

The Seller undertakes to protect the personal data of the Buyers in accordance with the Personal Data Protection Act and undertakes not to disclose the personal data to third parties without the consent of the Buyer (except for data necessary for business partners to deliver the purchased product). Excluded from this are cases in which the Seller, by a valid order of the authorized state bodies, in accordance with the law, is obliged to submit or allow access to the personal data of the Buyers.

The seller does not record your credit card number or store transaction data, but uses the services of a third party, an authorized bank, which protects your data with encryption.

The customer has the right to request the addition, correction or modification of incorrect personal data.

Privacy Statement and Confidentiality of Personal Data ROTO DINAMIC d.o.o. is responsible for all proprietary websites and all data contained and complies with the General Regulation on Personal Data Protection.

Due to User registration while using the Web store, the Seller collects and processes the User's data with his consent for the purpose explicitly stated in the consent, and in accordance with Article 7 of the Personal Data Protection Act. In case the User wants to revoke the issued consent, he can do the same by logging off to unsubscribe or sending an e-mail to dpo@rotodinamic.hr. Upon receipt of the request for revocation of consent, the Seller will permanently destroy all data about the User, except those that he is obliged to keep in order to fulfill its obligations to the User or due to obligations prescribed by positive regulations of the Republic of Croatia. If the User does not withdraw the issued consent, the Seller stores and processes personal data only for as long as necessary to perform a certain legitimate purpose, unless the applicable regulations provide for a longer period of storage for a particular purpose. In the case of giving consent to marketing, we keep the data until the consent is revoked.

By making efforts to maintain the website according to the needs of our users with the information they need, we use technology that collects, processes and selects data on how our website is used. We collect this information through cookies.

Purpose of data collection

• Product sales - to process your sales
• Customer support and marketing - for answering inquiries and giving news and offers
• Personal data may be transferred to third parties, provided that there is a legal basis for the transfer:
• For the implementation of the contract for the delivery of goods, we will share the data with the distribution service providers with whom we cooperate and have concluded contracts. The distribution service provider, according to its business conditions, may request the user's personal document for inspection and / or record certain data from the document when delivering goods or services. If the user is not willing to submit such information necessary for the delivery of the package, ie proof of the customer, the service or goods will not be able to be performed or delivered.
• To state institutions that request data for inspection due to some third processing of the same data
• Companies that are professionally engaged in automated sending of advertising messages of Companies that the Seller uses for the development and implementation of online services

Web shop
Access to the web shop is possible with or without registration.
During registration, the Customer may be asked for certain personal data such as name and surname, e-mail address, residential address, telephone number. Upon registration, the Customer accesses his database on the Web Shop.

When purchasing without registration, only the data necessary for the delivery of the purchased goods are collected and the specified data is stored for the purpose of fulfilling the contract.

The user of the Website can choose whether or not he wants to receive promotional messages, regardless of whether he has registered through the Website or not. The data provided by the user during registration are stored on the Web store server and in the business program to which the employees of the competent department have access, along with the codes for access to the business program.
The Customer may deactivate his registration at any time.

Personal data storage locations

All data is stored on several media:

• Information about the user as a customer: on the web shop located in the leased part of the company that provides space on the web named DHH d.o.o.
• In the Point P2000 business program for delivery purposes


The registered user has the possibility to access his data stored on the website at any time, where he can revise, change and delete it. All changes made to the website will be recorded within the business program itself.

6) Written consumer complaint
